Mahakama yapata kigugumizi Yashindwa kufuta Sheria ya Mirathi

MAHAKAMA Kuu ya Tanzania, Kanda ya Dar es Salaam, imekataa kufuta Sheria ya Mirathi ya Kimila ya mwaka 1963, katika kesi ya kikatiba namba 82/2005, iliyofunguliwa na wajane wawili kutoka mkoani Shinyanga.
Wajane hao waliomba mahakama ibatilishe sheria hiyo kwa maelezo kwamba inakinzana na Katiba ya Jamhuri ya Muungano wa Tanzania ya mwaka 1977.
Jopo la majaji watatu, Salum Massati, Augustine Shangwa, wakiongozwa na Jaji Thomas Mihayo, walisema mahakama inakiri kuwa sheria hiyo ina ubaguzi, hata hivyo mahakama haiwezi kuamuru ifutwe kwa vile mila za makabila ya Kitanzania zinaendelea kukua na kubadilika kila kukicha.
Jaji Mihayo alisema sheria hiyo iliyotamkwa kwenye tamko la serikali la mwaka 1963, ikifutwa ni wazi makabila mengine yatadai sheria zinazoyabana zifutwe.
“Kweli tumeona sheria hii ina ubaguzi ila na tumeshindwa kuifuta kwa kuwa mila zinaendelea kukua na kubadilika kila kukicha na endapo tungeifuta sheria hii, ni wazi kesi nyingi za makabila tofauti zingefunguliwa mahakamani kupinga sheria za mila za makabila yao,” alisema Jaji Mihayo.
Walalamikaji walikuwa wakitetewa na jopo la mawakili 12 chini ya uongozi wa wakili wa kujitegemea wa Kampuni ya uwakili ya Adili, Alex Mgongolwa.
Mlalamikiwa ambaye ni Mwanasheria Mkuu wa Serikali, alitetewa na wakili wa serikali, Thomas Mtingwa.
Kesi hiyo ilifunguliwa mwaka jana na Elizabeth Stephen na Salome Charles, ambao walikuwa wanadai sheria hiyo ni ya kibaguzi dhidi ya wanawake, hivyo inakinzana na Katiba.
Pia walisema inapingana na maazimio na mikataba ya kimataifa ya haki za binadamu ambayo Tanzania imeridhia.
Baada kutolewa kwa uamuzi huo, Mgongolwa alisema uamuzi wa mahakama unapingana na ibara ya 30(5) ya Katiba inayopinga aina zote za ubaguzi.
“Hatujaridhishwa na uamuzi huu, hivyo mimi na wenzangu tumekubaliana tutakata rufaa katika Mahakama ya Rufani mapema wiki ijayo,” alisema.
Naye, wakili Nakazael Tenga, alisema kulikuwa hakuna haja mahakama kukataa kufuta sheria hizo kwa kuwa tayari jopo hilo la majaji limekiri kuwa sheria hizo ni za kibaguzi.
